Re: Notification of Filing of Lawsuit by CH. Karnchang Public Company
Limited in the capacity as partner of the Joint Venture BBCD and on
behalf of the Joint Venture BBCD

Reference is made to the fact that on February 15, 2007, the Supreme
Court issued the judgment in the case where the Joint Venture BBCD had filed a
lawsuit requesting the Civil Court of Southern Bangkok to enforce an arbitral
award and the Civil Court of Southern Bangkok had adjudged requiring the
Expressway and Rapid Transit Authority of Thailand to make payments to the
Joint Venture BBCD in accordance with the arbitral award of the Thai
Arbitration Institute. The Expressway and Rapid Transit Authority of Thailand
filed its appeal with the Supreme Court. The Supreme Court then adjudged
refusing to enforce the arbitral award, in relation to which CH. Karnchang
Public Company Limited did report to the Stock Exchange of Thailand. On
February 5, 2008, the Company's Board of Directors Meeting resolved to grant
approval for the Company, in the capacity as partner of the Joint Venture BBCD
and on behalf of the Joint Venture BBCD, to file a lawsuit with the Court to
claim such increased costs against the Expressway Authority of Thailand.
The Company hereby notifies you that on February 11, 2008, CH.
Karnchang Public Company Limited, in the capacity as partner of the Joint
Venture BBCD and on behalf of the Joint Venture BBCD (the Plaintiff), has
filed a lawsuit against the Expressway Authority of Thailand (the Defendant)
with the Civil Court on grounds or charge of undue enrichment, claiming for
the increased costs, including interest calculated up to the date of filing of
the lawsuit, in the total amount of Baht 9,683,686,389.76. This case is
currently pending the Court's consideration.
